DO ALL DOCTORS HAVE INSURANCE ?

IS IT ETHICAL/FRAUD TO COLLECT MEDICARE AND MEDICAID BENEFITS FOR MEDICAL MAL PRACTICE?

MEDICARE AND MEDICAID FRAUD BY PHYSICIANS

WHO CAN SUE

The information on this site applies to Florida only

If a hospital is involved in your injury, you may actually be able to sue the hospital for allowing the doctor to practice there without the required insurance or assets. See your lawyer about that.

Dr. Suits implanted a penil prosthesis in me for better ED performance. This prosthesis is manufactured by American Medical Systems (AMS) AMS 700 Series prosthesis. The after effects of Cialis and Viagra were very bad so he sold me on this device. Procedure and Operating Room Manual. Scroll down. There are 28 pages of PDF information. More procedures.

Instead of following the Hippocratic Oath, as most medical professionals do, others follow the deceitful way of avoiding lawsuits; ie: Tough Talk: A Tool Box for Errors.

Penile prosthesis implants have been on the market for about 25 years. A San Francisco newspaper article in 1994 estimated that 300,000 men have undergone penile implant surgery since 1973. It has been estimated that American Medical Systems, Inc. (AMS) has sold 120,000 products. Approximately 715 individual cases were filed against AMS in the late 1990s.

I allege mal practice; Medicare/Insurance fraud; etc. Dr. Suit's final words, "I'm sorry I did the best I could." These un-consoling words were spoken after three botched operations, and leaving an object inside me...the patient. He told my wife and daughter, after the removal of the device ( the reservoir still fused to my pelvic area), not to tell me about leaving the device in me. It wasn't enough I suffered excruciating pain from 11/20/07 to 4/08/08, and was permanently damaged. The two cylinders were fused to my penis. When ripped out they tore at my penis tissue, thereby destroying any chance of an erection. Because of the three operations that sliced open my testicles they have never been the same. I have pain in that area since the operations. Dr. Suits stole from my wife and I something very sacred to lives together. prior to the three operations I was able to perform as a healthy male with the help of Viagra or Cialis. Now...NOTHING!!!

I spoke to the Clinical Patient Advocate of Martin Memorial Hospital Health Systems. Instead of supporting me in her capacity, I was treated as a second rate citizen. She claims, in a letter 1/7/09, that Dr. Suits informed both my wife about the portion of the prosthesis was not removed, and that he told both my wife and I during my April 8, 2008 hospitalization and during a visit to his office together after discharge. A BOLD FACED LIE!!!! At the hospital he told my wife and daughter not to tell me because of psychological ramifations I might encounter knowing this! My wife told me later when I was home about leaving the reservoir in me. She was following Dr. Suits instructions, but couldn't keep this a secret any longer.

I received another letter, this time from the Corporate Director Risk Management of Martin Memorial Hospital, dated August 18, 2009. She assured me my complaint was thoroughly reviewed. Her closing statement was, "I would also suggest you review your planned website postings with your attorney." That being said, I allege Martin Memorial never looked into the matter, and I would like to see a document from Dr. Suits stipulating he discussed my botched operation(s) with my wife and I at the hospital. My daughter will also sign an affidavit confirming Dr. Suits blatent lie that I was privy to that conversation together with my wife and daughter at the hospital. For that matter, that discussion never took place, at the hospital or his office.

When he removed the prosthesis, the cylinders on both sides of my penis ripped my tissue away from my penis leaving me totally impotent. I could no longer achieve an erection, and never will. My testicles have never restored to normal after being cut and butchered three times. The reservoir was left because it adhered to my pelvic area.To note: I have had a second opinion by a urologist practicing out of Jupiter Florida.

I have sent, certified letters, faxes and made numerous telephone calls to his office to release, to me, my records and any papers I signed, which is the Florida law. To date I have not heard from him or have I received the documents requested. I allege he has committed a criminal act. It was not before I contacted the Division of Medical Quality Assurance Consumer Services Unit that Dr. Suits was forced to send me my records October 1 2009.

After removing the implant I was to receive post opertive instructions...never happened! There is a saying in the Navy, "that if I was 2 inches shorter, I would have been in the Waves (womans branch of the Navy).

Memorandum
To: Mr. Patrick Brilliant, CEO - Clevleand Clinic/Hospital

Re: Mal Practice - Barbaric and inhumane medical practice procedures akin to Abner Louima at the hands of New York Police Department personnel. Mr. Louima had a handle of a toilet plunger "rammed" up his rectum. I felt terrified and feel that I was sodomized, raped, brutalized and tortured by Dr. Weiss and Cleveland Clinic/Hospital.

Prior to my admission, July 25, 2001, to Clevleand at Weston I had been seen by Dr. Minda Neimark. I was suffering from an excruciating pain on my left side accompanied by nausea, vomiting, and rectal bleeding. On 7/24/01 Dr. Neimark examined me. Although she could not see anything with a vaginal probe, she had felt something in the region where I was having problems. Dr. Neimark immediately had me examined by the Gasrointenal Department where they did a scan. I was told to return to Stuart, where I reside, and if my problem persisted I was to notify the hospital. I called the evening I returned to Stuart and was told to return the following day to be admitted. Before I was admitted, Dr. Weiss examined my sigmoid colon and found trace blood and clots.

I was admitted approximately 5:30 p.m. I was given IV fluids due to dehydration with an order for compazine in conjuction with N.P.O. My mother, an RNBSN, was with me for the entire duration of my stay. Three times she requested the nursing staff to start the IV. It wasn't until 7:30 p.m. that a port was placed in my right arm. I was given an injection for nausea and fell asleep. My mother went to dinner and returned at 10:30 p.m. and requested the nursing staff to start the IV fluids, which they did. They said they could not find the proper IV tubing.

The following day I complained my arm with the IV was hurting, but nothing was done to relieve my pain. Finally a GI intubation was administered. I had informed the staff of my extremely high tolerance to medications. The medication was administered by nurse Susan Boisvenue as per Dr. Weiss's instructions. She stood by my side and calmly assured me that everything would be fine. The medication was not strong enough so I was given more.

On 7/26/01 my mother complained to the desk that the IV had infiltrated into my right arm. Hours later an IV was inserted into my left arm. An assisting physician, who was from Barcelona, Spain, by the name Jorge (last name unknown) spoke to me about the risks of a colonoscopy. I emphasized strongly my concerns about my tolerance to medications and that the proper amount should be administered in order to sedate me. I was told not to worry and he said, quote, "when I had my colonoscopy, all I remember saying was, should I take off my glasses? He then awoke in his room." Unfortunately, this was not my experience!

I was brought into the room with the attending physician, nurse Boisvenue and Dr. Weiss who to perform the procedure. My mother was refused attendance during the procedure. She requested that she be present since she was a nurse and I was her daughter. She also told them I was a recovered alcoholic with fourteen years of sobriety. She also made them aware of addition medication may be needed for the procedure.

They began giving me anesthesia. I was making small talk when Dr. Weiss turned to me and said, "why don't you shut up and relax." I then kept quiet. Immediately, just as the procedure began, I asked to stop.I explained to him that it was extremely painful. I began to cry and pleaded for more medication. I was holding onto the rail saying the "Our Father" outloud. At the same time nurse Boisvenue was saying," it's OK, we're almost halfway there." I never felt pain as I was feeling then. It was unbearable. I was screaming and crying. There was no to the pain! I kept telling him to stop. The nurse continued to hold my hand and I squeezed hard. No doctor responded but kept shoving the tube into me. I was awake during the entire procedure. After my ordeal I was wheeled out of the room crying and left at the desk with a box of tissues. Eventually I was brought to a room for two patients. I was given fluids and something light to see if I could tolerate food.

My mother was waiting in the surgical waiting room. Dr. Weiss went to see her, invaded her personal space and coldly told her that the findings were normal. My mother questioned him what he meant by normal and he snapped back with a curt remark, "that's what normal means…normal!"

My mother was never told that I was back in my room. She was made to believe I was in recovery. She sat in that room for three hours until she questioned the staff about my whereabouts. When she arrived at my room I was till crying and wasn't given any liquids as yet. She had Dr. Weiss paged. He never answered the page.

Judy Brenner, a nurse administrator, was at the desk and overheard my mother's complaints. At the same time a physician from the Endo department called the desk and the nurse supervisor asked if he would talk with a Caputo family member.? He said "NO!" Then nurse Brenner accompanied my mother to my room where she was told of my experience. She promised to return with Dr. Weiss. In addition I was told with food since the kitchen was closed and off schedule. Instead nurse Brenner returned with a meal of solids and said Dr. Weiss was not available, but would get him later. After I finished the meal I started packing my belongings to leave. After being discharged I was still waiting for Dr. Weiss, who never did return. On my return to Stuart I experienced tremendous pain. I again beeped Dr. Weiss. He did not respond.

In conclusion:

1- My IV was delayed many hours even though I was admitted with dehydration.
2- My right arm was infilterated and is still showing track marks.
3- My colonoscopy was cruel and inhuman. It did not meet the Florida Hospital Bill of Rights and Responsibilities (copy to attorney).

a) "A patient has the right to expect information about pain and pain relief, and a concerned staff committed to pain prevention and management, who will believe his or her reports of such pain and respond quickly."
b) "A prompt and reasonable response to questions and requests."
c) "To be treated with courtesy and respect, with appreciation of his or her dignity."
